{"id":13448,"date":"2012-08-08T20:02:13","date_gmt":"2012-08-09T00:02:13","guid":{"rendered":"http:\/\/theredphoenixapl.org\/?p=13448"},"modified":"2012-08-08T20:02:13","modified_gmt":"2012-08-09T00:02:13","slug":"above-the-law-court-throws-out-warrantless-wiretap-suit","status":"publish","type":"post","link":"https:\/\/redphoenix.news\/es\/2012\/08\/above-the-law-court-throws-out-warrantless-wiretap-suit\/","title":{"rendered":"Above the Law: Court Throws Out Warrantless Wiretap Suit"},"content":{"rendered":"<p><a href=\"https:\/\/i0.wp.com\/redphoenixnews.com\/wp-content\/uploads\/2012\/08\/obama-partye-time.jpg\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-13449\" title=\"Obama-partye-time\" src=\"https:\/\/i0.wp.com\/redphoenixnews.com\/wp-content\/uploads\/2012\/08\/obama-partye-time.jpg?resize=420%2C320\" alt=\"\" width=\"420\" height=\"320\" \/><\/a><\/p>\n<p><span style=\"color:#000000;\"><strong>Feds Can&#8217;t Be Sued for Illegally Spying on Americans<\/strong><\/span><\/p>\n<p><span style=\"color:#000000;\">The US Court of Appeals for the Ninth Circuit <span style=\"color:#0000ff;\"><a href=\"http:\/\/www.politico.com\/blogs\/under-the-radar\/2012\/08\/appeals-court-tosses-warrantless-wiretapping-suit-131342.html\"><span style=\"color:#0000ff;\">has<\/span><\/a><\/span> thrown out the only lawsuit ever likely to advance on the federal government\u2019s warrantless wiretapping, declaring in their <span style=\"color:#0000ff;\"><a href=\"\/es\/%3Ca%20href=\/\"><span style=\"color:#0000ff;\">ruling<\/span><\/a><\/span> that the executive branch is above the law in this case.<\/span><\/p>\n<p><span style=\"color:#000000;\">The lawsuit centered on <span style=\"color:#0000ff;\"><a href=\"http:\/\/www.wired.com\/threatlevel\/2012\/08\/appeals-court-oks-wiretapping\/\"><span style=\"color:#0000ff;\">illegally<\/span><\/a><\/span> intercepting lawyers\u2019 telephone calls without judicial approval, and while the court didn\u2019t dispute the previous ruling that the surveillance was against the law, they insisted that no damages could be paid to the plaintiffs.<\/span><\/p>\n<p><span style=\"color:#000000;\">The ruling says that since Congress never explicitly allowed the government to be sued for damages in this case, no such damages could ever be awarded and that the executive branch has \u201csovereign immunity\u201d from being sued even for breaking the law.<\/span><\/p>\n<p><span style=\"color:#000000;\">The lawsuit was a particularly convoluted one, with the Bush Administration accidentally admitting to spying on the lawyers and then classifying the admission after the fact, arguing that there was no evidence it ever happened. The Obama Administration continued the appeals process with the argument that lawsuits against the government in and of themselves are unacceptable unless Congress explicitly allows them.
