{"id":15689,"date":"2012-12-19T05:12:38","date_gmt":"2012-12-19T10:12:38","guid":{"rendered":"http:\/\/theredphoenixapl.org\/?p=15689"},"modified":"2012-12-19T05:12:38","modified_gmt":"2012-12-19T10:12:38","slug":"court-rules-antiwar-activists-can-sue-government-spies","status":"publish","type":"post","link":"https:\/\/redphoenix.news\/es\/2012\/12\/court-rules-antiwar-activists-can-sue-government-spies\/","title":{"rendered":"Court Rules Antiwar Activists Can Sue Government Spies"},"content":{"rendered":"<h4><a href=\"http:\/\/theredphoenixapl.org\/2012\/12\/19\/court-rules-antiwar-activists-can-sue-government-spies\/dhs-seal-800-753514\/\" rel=\"attachment wp-att-15690\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" class=\"aligncenter  wp-image-15690\" alt=\"dhs-seal-800-753514\" src=\"https:\/\/i0.wp.com\/redphoenixnews.com\/wp-content\/uploads\/2012\/12\/dhs-seal-800-753514.jpg?resize=392%2C294\" width=\"392\" height=\"294\" \/><\/a><\/h4>\n<h4 id=\"pagesub\"><span style=\"color:#000000;\">The legal action is against a US military agent used by Homeland Security to spy on peace activists.<\/span><\/h4>\n<p><span style=\"color:#000000;\">A federal appeals court involving antiwar activists who were secretly infiltrated by US military spies\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/www.nlg.org\/news\/court-rules-peace-activists-can-sue-us-military-infiltration\"><span style=\"color:#0000ff;\">has ruled in favor of the activists<\/span><\/a><\/span>,\u00a0marking the first time a court has endorsed the people\u2019s ability to sue the military for violating their First and Fourth Amendment rights.<\/span><\/p>\n<p><span style=\"color:#000000;\">\u201cDeclassified documents obtained by Students for a Democratic Society and Port Militarization Resistance,\u201d<span style=\"color:#0000ff;\"><a href=\"http:\/\/www.democracynow.org\/2012\/12\/18\/headlines#121810\"><span style=\"color:#0000ff;\">reports<\/span><\/a><\/span>\u00a0Democracy Now, \u201crevealed a man everyone knew as \u2018John Jacob\u2019 was in fact John Towery,\u201d who was assigned by the government to spy on the Washington state-based antiwar groups.<\/span><\/p>\n<p><span style=\"color:#000000;\">Towery was dispatched from a \u201c<span style=\"color:#0000ff;\"><a href=\"http:\/\/antiwar.com\/blog\/2012\/10\/18\/fusion-center-boston-police-spied-on-peace-activists\/\"><span style=\"color:#0000ff;\">fusion center<\/span><\/a><\/span>,\u201d or\u00a0intelligence center, as part of the Department of Homeland Security\u2019s post-9\/11 anti-terrorism surveillance powers.<\/span><\/p>\n<p><span style=\"color:#000000;\">In October, the Senate Homeland Security subcommittee reviewed more than 600 reports that had come out of these so-called fusion centers and\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/news.antiwar.com\/2012\/10\/03\/intelligence-effort-wasted-billions-watched-citizens-abused-civil-liberties\/\"><span style=\"color:#0000ff;\">found<\/span><\/a><\/span>\u00a0the giant bureaucracy surrounding the program produced almost nothing that had to do with countering terrorist threats.<\/span><\/p>\n<p><span style=\"color:#000000;\">Instead, the government spy networks snooped on political activists and infiltrated groups that were peacefully exercising their constitutional rights to free speech.<\/span><\/p>\n<p><span style=\"color:#000000;\">\u201cThe centers have made headlines for circulating information about Ron Paul supporters, the ACLU, activists on both sides of the abortion debate, war protesters and advocates of gun rights,\u201d\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/bigstory.ap.org\/article\/intelligence-effort-named-citizens-not-terrorists\"><span style=\"color:#0000ff;\">according to the Associated Press<\/span><\/a><\/span>.<\/span><\/p>\n<p><span style=\"color:#000000;\">The court ruling is potentially precedent-setting, although Towery\u2019s lawyers may appeal the decision.<\/span><\/p>\n<p><span style=\"color:#000000;\">\u201cThis has never been done before,\u201d said Larry Hildes, an attorney with National Lawyers Guild, who is handling the case. \u201cThe US government has spied on political dissidents throughout history and this particular plot lasted through two presidencies, but never before has a court said that we can challenge it the way we have.\u201d<\/span><\/p>\n<p><a href=\"http:\/\/news.antiwar.com\/2012\/12\/18\/court-rules-antiwar-activists-can-sue-government-spies\/\"><span style=\"color:#0000ff;\">Fuente<\/span><\/p>\n<p><\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>The legal action is against a US military agent used by Homeland Security to spy on peace activists.
