CVS \u2013 the once thought of drug and convenience store will now be known as the store that defends its manager\u2019s rights to\u00a0kill<\/strong><\/span><\/a><\/span>\u00a0shoplifters\u2026even those that are caught taking a single tube of toothpaste. Death for toothpaste. Would anyone ever exchange $5.00 toothpaste tube for their life?<\/span><\/p>\n

This incident<\/span>\u00a0occurred<\/strong><\/span>\u00a0<\/a>in Chicago back in 2010. \u00a0A homeless man, Anthony Kyser was choked to death after a pharmacy manager chased him out of a CVS store for stealing toothpaste\u2026.and today, the chilling video of the incident has surfaced.<\/span><\/p>\n

The grainy surveillance video from the alley near the Little Village CVS was obtained from a source by<\/span>\u00a0DNAinfo.com Chicago<\/strong><\/span><\/a><\/span>. The video shows Kyser being surrounded by the CVS manager and several other people who were helping the manager hit, kick, and pile on top of the already subdued man.<\/span><\/p>\n

Charges were never brought up against Pedro as the police originally stated, \u201cThe video was reviewed by detectives as part of their investigation at the time,\u201d Chicago Police Department spokeswoman Lt. Maureen Biggane said. \u201cIt was determined that criminal charges were not warranted.\u201d<\/span><\/p>\n

Hmmm\u2026 a man steals a tube of toothpaste, he\u2019s killed, and that\u00a0doesn\u2019t\u00a0warrant further investigation or charges?<\/span><\/p>\n

Anthony Kyser was a 35-year old homeless man who had a family, and that family is seeking some justice. Anthony\u2019s mother, Ann Marie Kyser, filed a lawsuit claiming the store manager committed battery and that CVS is liable. That case is still pending in Cook County Circuit Court, with an outcome not likely to make anyone happy.<\/span><\/p>\n

Jack Kennedy, an attorney with Cochran, Cherry, Givens, Smith & Montgomery, the law firm representing Kyser\u2019s mother said:<\/span><\/p>\n

I think it\u2019s appalling that CVS maintains that an employee can choke someone to death if they steal from a CVS store.<\/span><\/p><\/blockquote>\n

A CVS spokesman would only tell<\/span>\u00a0DNAinfo.com<\/strong><\/span><\/a><\/span>\u00a0that the company does not comment on pending litigation.<\/span><\/p>\n

However,through his attorney, Villanova acknowledges he \u201cheld onto Anthony Kyser on the ground while defending himself after being struck,\u201d according to court records. The video shows no strike to Pedro.<\/span><\/p>\n

In court filings, Villanova acknowledges his \u201carm came into contact with decedent Anthony Kyser\u2019s throat\u201d and he heard Kyser say \u201cI can\u2019t breathe.\u201d<\/span><\/p>\n

Soon after Kyser\u2019s death, an outraged U.S. Rep. Bobby Rush, a Chicago Democrat, sent a letter to Cook County State\u2019s Attorney Anita Alvarez demanding action for the \u201cbrutality visited upon a homeless man.\u201d<\/span><\/p>\n

Rush now says his \u201ccalls for justice\u201d were not heeded. Now, after being shown the video by DNAinfo.com, he said he hopes its release will reopen the investigation.<\/span><\/p>\n
