{"id":17902,"date":"2013-05-21T15:55:52","date_gmt":"2013-05-21T19:55:52","guid":{"rendered":"http:\/\/theredphoenixapl.org\/?p=17902"},"modified":"2013-05-21T15:55:52","modified_gmt":"2013-05-21T19:55:52","slug":"in-colorado-blacks-make-up-4-percent-of-the-population-and-100-percent-of-death-row","status":"publish","type":"post","link":"https:\/\/redphoenix.news\/es\/2013\/05\/in-colorado-blacks-make-up-4-percent-of-the-population-and-100-percent-of-death-row\/","title":{"rendered":"In Colorado, Blacks Make Up 4 Percent Of The Population And 100 Percent Of Death Row"},"content":{"rendered":"<p><a href=\"https:\/\/i0.wp.com\/redphoenixnews.com\/wp-content\/uploads\/2013\/05\/death-penalty3-300x220.jpg\"><img data-recalc-dims=\"1\" decoding=\"async\" loading=\"lazy\" class=\"aligncenter size-full wp-image-17903\" alt=\"death-penalty3-300x220\" src=\"https:\/\/i0.wp.com\/redphoenixnews.com\/wp-content\/uploads\/2013\/05\/death-penalty3-300x220.jpg?resize=300%2C220\" width=\"300\" height=\"220\" \/><\/a><span style=\"color:#000000;\">By<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/thinkprogress.org\/author\/nflatow\/\"><span style=\"color:#0000ff;\">Nicole Flatow<\/span><\/a><\/span><\/p>\n<p><span style=\"color:#000000;\">In March, Colorado came close to<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/thinkprogress.org\/justice\/2013\/05\/02\/1956511\/maryland-governor-signs-death-penalty-repeal\/\"><span style=\"color:#0000ff;\">becoming the 19th state<\/span><\/a><\/span>\u00a0<span style=\"color:#000000;\">to abolish the death penalty, but the<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/www.denverpost.com\/breakingnews\/ci_22874746\/house-committee-take-up-death-penalty-repeal-bill\"><span style=\"color:#0000ff;\">bill failed<\/span><\/a><\/span>\u00a0<span style=\"color:#000000;\">after Gov. John Hickenlooper (D) voiced opposition and suggested a possible veto. A few months later, Colorado\u2019s death penalty is still firmly in place, and the state is poised to complete what would be only the second execution in 45 years (the last was in 1997). Few dispute that Nathan Dunlap committed a horrific crime and murdered several people at a Chuck E. Cheese. But judges, university professors, and other prominent state leaders are\u00a0<\/span><span style=\"color:#0000ff;\"><a href=\"http:\/\/www.cofpd.org\/topics-of-interest\/clemency-dunlap.html\"><span style=\"color:#0000ff;\">urging Gov. Hickenlooper<\/span><\/a><\/span>\u00a0<span style=\"color:#000000;\">to commute Dunlap\u2019s sentence, both because crucial errors that defined his trial may have led him to get a harsher sentence than others, and because killing anyone under the perverted state system would be a miscarriage of justice. According to letters filed with Hickenlooper\u2019s office:<\/span><\/p>\n<ul>\n<li><span style=\"color:#0000ff;\"><a href=\"http:\/\/www.cofpd.org\/docs-dun\/8-01_-_letter_from_13_retir.pdf\"><span style=\"color:#0000ff;\">All three people<\/span><\/a><\/span>\u00a0<span style=\"color:#000000;\">on death row are black men. In a state that is only 4.3% African American,\u00a0<strong>Colorado\u2019s death row is 100% African American.<\/strong><\/span><\/li>\n<li><span style=\"color:#000000;\">All three men on death are\u00a0<strong>from the same one county<\/strong>, out of Colorado\u2019s 64.<\/span><\/li>\n<li><span style=\"color:#000000;\">All three men\u00a0<strong>committed their crime when they were under the age of 21<\/strong>.<\/span><\/li>\n<li><span style=\"color:#000000;\">Two law professors who studied Colorado\u2019s application of the death penalty<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/www.denverpost.com\/breakingnews\/ci_22874746\/house-committee-take-up-death-penalty-repeal-bill\"><span style=\"color:#0000ff;\">concluded it was unconstitutional<\/span><\/a><\/span><span style=\"color:#000000;\">, after finding that prosecutors pursue the death penalty in less than one percent of the cases where it is an option, and that the\u00a0<strong>state\u00a0failed to set \u201cclear statutory standards for distinguishing between the few who are executed and the many who commit murder.\u201d<\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"color:#000000;\">\u201cIt appears that race, geography and youth largely determines who gets the death penalty in Colorado,\u201d wrote a group of NAACP leaders in a letter urging Gov. Hickenlooper to grant clemency. They note that not a single black juror served on the panel that sentenced Dunlap to death.<\/span><\/p>\n<p><span style=\"color:#000000;\">In addition to the injustices that define the Colorado system, a group of former Colorado judges also point out that Dunlap\u2019s bipolar disorder and psychotic tendencies were not even mentioned at trial. In fact,<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/www.cofpd.org\/docs-dun\/8-01_-_letter_from_13_retir.pdf\"><span style=\"color:#0000ff;\">according to their letter<\/span><\/a><\/span><span style=\"color:#000000;\">, Dunlap\u2019s lawyer told the jury that there was no explanation for his violence.<\/span><\/p>\n<p><span style=\"color:#000000;\">The judges add that \u201cno clear evidence exists that the death penalty deters violent crime.\u00a0What it does in our current system, as in this case, is to drain our judicial system of\u00a0millions of dollars as mandatory appeals drag on for decades.\u201d Studies have shown that the death penalty<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/thinkprogress.org\/justice\/2013\/04\/22\/1808041\/viewpoint-the-case-against-the-death-penalty-for-dzhokhar-tsarnaev\/\"><span style=\"color:#0000ff;\">does not lower the homicide rate<\/span><\/a><\/span><span style=\"color:#000000;\">. In fact, the<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/thinkprogress.org\/justice\/2013\/04\/22\/1808041\/viewpoint-the-case-against-the-death-penalty-for-dzhokhar-tsarnaev\/\"><span style=\"color:#0000ff;\">murder rate is lower<\/span><\/a><\/span>\u00a0<span style=\"color:#000000;\">in states without the death penalty.\u00a0Hickenlooper says he<\/span>\u00a0<span style=\"color:#0000ff;\"><a href=\"http:\/\/www.denverpost.com\/breakingnews\/ci_23165060\/hickenlooper-holding-death-penalty-case-meetings\"><span style=\"color:#0000ff;\">continues to wrestle<\/span><\/a><\/span>\u00a0<span style=\"color:#000000;\">with the death penalty, and whether to commute Dunlap\u2019s sentence.<\/span><\/p>\n<p><span style=\"color:#0000ff;\"><a href=\"http:\/\/thinkprogress.org\/justice\/2013\/05\/21\/2044001\/in-colorado-blacks-make-up-4-percent-of-the-population-and-100-percent-of-death-row\/?mobile=nc\"><span style=\"color:#0000ff;\">Fuente<\/span><\/a><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>By\u00a0Nicole Flatow In March, Colorado came close to\u00a0becoming the 19th state\u00a0to abolish the death penalty, but the\u00a0bill failed\u00a0after Gov.
